Legal Question in Criminal Law in Massachusetts

Disorderly Person

I got an adult complaint notice in the mail where I was to appear at a hearing at a courthouse for being ''401 disorderly person'' G.I. Ch. 272 Sec 53. On the notice, there were three apparent victims and ''no continuances will be granted'' marked in a big red stamp. The story goes, we were in a car and we threw water balloons at people, but did not hit them. My questions are: 1. Is the hearing mandatory? (I have finals that day and time) and also, 2. What is the situation for us? (Are we just going to do community service or is the punishment more severe.) 3. Is it a good idea to meet the complaintant ahead of time and apologize? We are very regretful. Thanks for any feedback.

Re: Disorderly Person

1. yes, you can probably get a continuance for what sound like a clerk's hearing;

2. Do not say anything that could be used against you;

3. Speak with an attorney; do not go to a clerk's hearing alone and withour counsel; unless you have a tight alibi who you can bring with you;

The biggest harm in court is what you do to yourself!!!
