domestic assault and battery

I called 911 and said that my husband threw a cup at me. He has never been charged with assault and battery before, but I mentioned on the 911 call that it occurred before. I did not press charges and am not going to testify against my spouse, but the DA is pursuing the case based on the 911 tape. Is it likely that the DA will eventually dismiss this case if it goes to a bench trial? What are the potential outcomes to this case.

Your husband should retain an attorney and not count on a dismissal. Good Luck!
