Hi my name is Donna and I have a couple questions.
My 19 year old son was summoms to magestrate hearing because of a fight between himself and another boy.
Offense #1:Assault with a dngerous weapon.
Victim: Conrad Burfiel, Faberge Egg
Offense #2: A & B
Victim: Conrad Burchfiel
Offense #3: Vandalize Properrty
Victim: Elaine Iagatta
Unsupervised, underage drinking party at Elaine Iagatta's home. Brian and Conrad had a fist fight. Things got broken during the fight.
Brian and parents show up for magestrates hearing. Neither Conrad Burchfiel nor Elaine Iagatta showed up for hearing. Belmont police read the charges to the magestrate, along with a written statement from Conrad Burchfeil stating he did not want to press charges on Brian.
The magestrate ordered Brian to pay restitution to the home owner (who didn't show up) and continued for 6 months. If Brian gets in trouble in that time frame the charges will be brought again.
My question is why do those charges hang over Brians head if Conrad does not want to press charges. Shouldn't they be dropped? Also why dont both boys in the fight have to pay restitution? They both agree they fought.
