Legal Question in Criminal Law in Massachusetts

How do I go about droping charges?

I was told this morning that I could not drop domestic abuse charges. Please know that I am not a stupid woman but I have been lied to, I was asked what i would like to see happen to my friend I answered treatment, I find that the DA would like to rake him over the coals with more than he deserves. I would like to drop charges and retract my statement. I need guidance. thank you

You should either contact his attorney, or contact me on Tuesday, and I may be able to advise you.

The reaction you received is, unfortunately, not atypical.

Re: How do I go about droping charges?

The DA won't drop charges for domestic just because you want him/her to. If you are married, you can lawfully involke the marital privilege against testifying against your husband, and most likely the case would be dismissed on trial day (but NOT sooner), although if the police report containes excited utterances, the DA could stll try the case using your statements preserved in the police report.

You should retain an attorney to negotiate a dismissal with your consent with the DA and speak only with that attorney lest you be charged with filing a false report should it appear in trying to retract your statement you initially gave false information.
