Legal Question in Criminal Law in Massachusetts
how do you go about dropping chargers on a person that threathen you. the person is going to be faceing a arraignment in a month. I live in the state of mass.
1 Answer from Attorneys
You don't. Once you file charges, it is up to the Commonwwealth to prosecute or not to prosecute. You should certainly contact the DA's office and make them aware of your intentions, but there is no guarantee that they will agree to drop them. Most likely, the accused will now have to hire an attorney to represent them. We have always been sucessful in asserting the rights of the defendant to avoid prosecution in cases like this, but it has taken defense counsel to get this done in most cases. If the person that you had charged needs counsel you can have them call us through my web site.
