The person has been charged with 2 drug charges and a motor vehicle charge. Depending upon the person's record, a good criminal lawyer who knows the system can get great results. I would need to know more about facts, person's prior record, if any, and status of case to provide more information. Please feel free to contact me further. Martha Kovner

It is not as simple as that.

But generally speaking, a first offense drug charge can result if a continuance without a finding, or a guilty plea. The former is where a person pleads and usually gets probation. After the sentence is over, the CWOF enters as a dismissal. The sentences vary with usually a 6 month probation for the possession of marijuana first offense.

There may be defenses to the nature of arrest.

I would suggest that you have an attorney review the police report, and discuss this matter with you. I may be biased, but given the charges, I would recommend getting an attorney.

I do criminal defense work, and you can contact me.
