Legal Question in Criminal Law in Massachusetts
I am an ex-convict who is trying to turn his life around for the better, is there anyway to have my record sealed so that employers cannot use it as a reason not to hire me? i am not a sex offender nor have i been convicted of any type of sexual act. what i am is a man who did some stupid things as a kid and i am still paying the price for it and its been over 14 years since i was last arrested but it is still keeping me from being able to get anywhere in life. is there any help out there for me??????

I seal CORIs for people quite often. What you need is a lot of time passing without new offenses and a compelling reason. 14 years and need of a job should do the trick. The law allows you to seal a record if it has been 10 yrs for misdemeanor and 15 yrs for a felony, from the last contact with the court witrhout any new events. This means from the last day of probation or from the day you paid the last penny of your fine, etc. NOt the date od arrest or the date of disposition, unless there was no probation or further court contact.
Since you are short of the actual 15 years, we must ask the judge to allow a motion to seal and the motion must be brought in the court where you were charged/sentenced (so every court if you have more than one charge to seal from more than one courts). It is not simple as pro se (without counsel) since we get a lot of people who say they tried and were denied. However, we have had excellent results.
