Expungement

If you were charged with 2 counts of assault and battery in Massachusetts and it was continued without a finding, can you get the records expunged? If so How?

In Massachusetts, you can seek to have your records sealed, but there is no provision for expungement. The difference between the two is that sealed records still indicate that there was an underlying charge and disposition, although the specific charge and the disposition are not revealed. Expungement, on the other hand, wipes the record completely clean, so there is no record of the underlying charge or the disposition.

While your record can not be expunged completely, you could retain a Massachusetts attorney to discuss the merits of having the record sealed so that there is restricted access to the offense and the disposition. Good Luck!
