extradition

What happens and what are my rights / obligations if I am charged with a white collar crime in Massachusetts but now live in Florida?

Any and every time you get stopped by the police and must produce identification you can be arrested on the active warrant and held while Mass. determines if they wish to spend the funds to send officers to escort you back to Mass. for trial.

You may wish to retain a Mass. attorney to deal with the case on your terms to see if it can be resolved so the warrant can be withdrawn. Good Luck!.

The charges remain in place and if there is an active warrant and you are stopped and asked for identification anywhere, including Florida, you may be picked up and held while the local authorities check to see if MA wants to extradite you (come down there and escort you back to MA). If yes, MA wil send State Troopers to physically come and get you and you will likely be held in prison until your case is resolved. If MA doesn't want to spend the time and money to extradite you, the local court will release you but you could go through the exact same hassel again the next time you are stopped, while the warrant remains active.

Putting all that aside, what you should do is hire an attorney here in MA to deal with the case. I have done this many times for people in similar circumstances. If it has been a long time, there is a good chance that evidence and witnesses may be unavailable. In any event, it is only a matter of time before you will be forced to deal with this issue. Do it proactively, on your terms. You will be far better off than waiting for that day when you are forced to deal with it on the court's terms.

Mass can seek your extradition. You can be arrested and held in jail.
