Legal Question in Criminal Law in Massachusetts

extridition

My fiance is incarcerated in Mass. He has an old charge in Florida for grand theft. His lawyer here has not even tried to find out what he can do to help that situation. I really have no idea if they are going to extradite him or not. I would like to know if you know the extradition laws in Florida and your proffessional opinion.

Re: extridition

Massachusetts lawyer cannot go to court in Florida unless he is licensed there. Massachusetts is likely holding your fiance on charges that he is a "fugitive from justive" for having left Florida and defaulted on a criminal case there. Massachusetts Courts will not care one way or the other about the end result of the Florida charges, however, they will care whether wishes to fight extradition to Florida or whether he will consent to be transported there to face the charge(s). The lawyer here in Massachusetts cannot "help the situation" in Florida... he or she can only represent your fiance for purposes of challenging or consenting to being shipped to the Florida Courts.
