Legal Question in Criminal Law in Massachusetts
My father told me I could leave some stuff at his house, until I was ready to take it. He has a big attic. I had a lot of brand new baby items and brand new baby furniture, as I am going through fertility treatments, and we were waiting until I was pregnant to remove those items. I had asked my father if he wanted me to put those items in storage while we were trying to get pregnant, and he said no to leave everything up in the attic. Well, recently I went up to his house to get some of the stuff and the attic was completely cleared out. Apparently, while my father was hospitalized, one of my sisters and her friends and husband went up to the attic and stole everything up there and has sold it, destroyed it or kept it. Since I had my father's permission to leave it up there and she never asked me to remove it, isn't that considered selling stolen property? Had she asked me to remove it I would have. I had everything I needed for the baby up there.

If you sister did take it, knowing it was yours, it would be stealing. However, what evidence do you have. Did you ask her? What did she say? Did anyone see her take the stuff out? Is it possible that your father mistakenly gave her permission? Why bringing charges against a sibling if a very personal decision, if she stole your items and sold them and you have evidence, you can call the police and report the crime. Also, you may apply for the issuance of a criminal complaint at the local district court.
