Legal Question in Criminal Law in Massachusetts

financial crime

I have not been charged with a crime but feel that I will soon, I deverted checks over the past year of over $100,000 into another business account that I setup. this account has just been put on hold and I want to give it all back, what is the best way to make this happen an avoid being charged with a crime?

If the account has been frozen, then someone already suspects malfeasance and was able to establish probable cause to freeze assets. Larceny in that degree is a serious offense and you are facing the possibility of a significant jail sentence. What you need now is someone who can help to successfully negotiatae a QUIET resolution. My recommendation to you is that you immediately hire a criminal lawyer who can go with you to the authorities to try and resolve the matter prior to any warrants for your arrest or complaints being issued. Many times cases are resolved at that stage if the court system has not been notified. This will be a tough one on account of the amount--butI have seen it done before. You are subject to a criminal complaint or indictment at this time. This means that the acts charged in themselves are criminal, and subject to a potential criminal sentence, including prison. An attorney, as the others stated, is in the better position to try to negotiate restitution of the money, and possibly avert the indictment or criminal complaint. Once these are filed, they sometimes take a life of their own. You don't say whoput a hold on the account, and under whose name the account is.
