Legal Question in Criminal Law in Massachusetts

gas cards stolen from work

I was approached at work today and accused of stealing 2 gas cards that were gifts to other employees whose payroll checks I deliver. I was put on temporary employee paid leave. They said that they will personally investigate this matter more and to try and prove that I did it after I told them that I didn't! What are my legal options at this point? And can they fire me for this with no proof?

You might wish to consider retaining an attorney to review your employee handbook, if any, and to discuss your options regarding your employer's "investigation".

You should discuss this only with your attorney as it could result in criminal charges for larceny as well. Good Luck!

In MA you are an employee at will, unless hired under a contract. This means that you can be fired for any reason or even no reason at all, as long as it is not discriminatory based on a few specific proteced categories such as race, color, religious beliefs, etc. Since you have not been charged with a crime, you have nothing to defend yourself against. If they charge you, get a good criminal defense attorney asap.
