Legal Question in Criminal Law in Massachusetts

Hanging Flyers Basis For Lawsuit?

Hi,

I had some trouble with a local business that refused to make right on some errors. A friend hung up some flyers about the issue, that basically said this company's mistakes cost me thousands of dollars. Next thing you know, I receive an email letter from his attorney threatening to sue me if I don't remove the ''slanderous and outrageous'' flyers by the end of the day. Is this a bluff, or should I be concerned? I have not responded to his email.

It's impossible to tell without knowing more. I think you should consult directly with a civil litigation attorney, and provide that person with a copy of the flyers and information about the specific details of what happened. Only then will you have any way to objectively know if you're on solid ground or thin ice. Good luck. In the meantime, to be safe, you're probably better off taking down the flyers until you confirm where you stand. (One last, small point: technically, the attorney for the business should have accused you of libel, not slander. The fact that they got it wrong is a little puzzling.)
