Legal Question in Criminal Law in Massachusetts

Hi,

I was convicted of a felony (in Massachusetts) shortly after I turned 18 (for destruction of school property - I think it's for malicious destruction). I am almost 28 now, with no trouble with the law since then. I believe I have changed as a person since then - I am a good employee and own a home in MA. I would like to try to pursue a public service career and possily join the army. I am wondering if anyone could let me know what they think the chances and difficulty would be in getting my felony removed or reduced to a misdemeanor.

Malicious Destruction of Property is a felony if the property damaged was valued at over $250.

Because Massachusetts does not allow you to "expunge" your record, you would either need to file a motion to "seal" your record or a motion to revise and revoke your (plea/conviction) of guilty. It sounds like you might be a strong candidate for the first option, but the second would require some serious maneuvering (they don't normally allow those types of motions - no matter how much you've turned your life around since then). While you could attempt to file one or both of these motions on your own, I would strongly suggest consulting with an attorney. This is the type of thing that can impact your opportunities going forward and you don't want to take it lightly (in other words, if you're going to do it make sure you do it right).
