I am charged with writing A bad check for 23000 if I pay the restitution can I avoid jail time

Under Massachusetts law there is no manadatory sentence for larceny. Whether you receive a sentence depends on many factors, including your prior record, if any, the nature of the offense, your background, the quality of your legal defense, the judge that decides the case, what the prosecution requests, whether you pay restituion and other factors.

The disposition of a case depends upon many different factors--prior record--if any, the Judge, the Prosecutor, how the "victim" feels about the case and how good your lawyer is. I would recommend going to court with an attorney who will be able to get you the best disposition. You have been charged with a felony and if you are convicted of it in addition to all the conditions the court might place on you, you would also have to report the conviction on all job applications and you would be required to give a DNA sample.
