my 16 year old babysitter stole and pawned jewelry thatis estimated at 8500.00 to replace along with some cash she has admitted this to the police and is facing charges what type of punishment does she face as a 1st time offender and will the courts order restitution?

As a 16 year old, she would only face committment to a state run loch-up facility by DCF (used to be DSS) until she reaches age 21. It is unlikely thatthe court will order that amount of restituion since, a court cannot order a term of probation that is not realistically "do-able." For an adult, $8,500 is do-able, but for a kid... even if the Assistant DA "promises" restitution, I would not hold my breath. The old fashioned "debtor prisons" have been outlawed.

As a more realistic alternative, you have the right to bring a civil lawsuit to recover the money and can sue the child's parents (who probably can-do $8,500). Let me know if you are interested, our office is nearby.
