Legal Question in Criminal Law in Massachusetts

Do we need a lawyer or should we just plead out

My son (who just turned 19) and his friends were caught with pot. While they were hanging out at a bomb fire. This is his first offense and is never in trouble. He was arrested but not read his rights at the time. This happened on a sat and He now has to go to court on Tuesday and we have no time to seek council (monday is a holiday). Im just not sure what to do. He did say it was ALL his though it was his and one of his friends. Should we just plead guilty and move on or should we get a lawyer. Please know we dont have a lot of financial means to help out here. Im scared for him and could use some help.

He should NOT plead guilty. The first court date is merely to enter a plea, which should be NOT GUILTY and also to determine if he is to get his own attorney. The court will have him evaluated by probation to determine if he is eligible for a public defender. If not he should, with your help retain counsel as there are many options to keep his record clean. Good Luck!

I would suggest that you find out whether or not you qualify for an attorney. If your son has no means he may be appointed an attorney by the court. Also, if he is 19, you can inquire as to whether or not there is a diversion program where he was arrested.

Also, most criminal lawyers have 24 hour availability - so if you need an attorney on Monday you can call the office and someone will get back to you (this is what my office does).
