Legal Question in Criminal Law in Massachusetts

Right to a lawyer

I am refused the right to an attorney in a criminal case of assault and battery against my brother-in-law. I have no money, no income, and my family is poor. What can I do when the court keeps reccomending me to get a lawyer but will not give me one as it says in the constitution and my miranda rights.

Re: Right to a lawyer

If the refusal is based on your financial status, ask the judge to recompute it.

If it based on a decision that you would not go to jail, I am not even sure that is proper.

In the absence of all other steps, you may wish to contact the attorney in charge of the county's bar advocate program for assistance. You can find their address and telephone number on the Committee for Public Counsel web page.
