Leaving the Scene When Not at Fault

I'm being charged with leaving the scene of property damage. Nobody was injured. In order to be found guilty, must it be proven that I was at fault for the accident? What if I am not at fault or the accident is no-fault? Thanks.

Re: Leaving the Scene When Not at Fault

It does not matter who was at fault in the accident for a Leaving the Scene of Property Damage or Leaving the Scene of Personal Injury. Both of those charges have to do with not staying at the scenen to either wait for police or to swap info with the other party if there were two parties involved. Hire a criminal defense attorney. It is a serious charge.

Re: Leaving the Scene When Not at Fault

Retain a criminal defense attorney and confide only in them, and not on the net, as it is irrelevant who was at fault for the accident. The charge is based on the allegation you failed to make yourself known before leaving the scene. Good Luck!
