My 20 year old daughter was involved in a incident with her car while her license was suspended and the police want to talk to her first before they charge her with anything should she talk to them before she has a lawyer knowing that she has charges pending

No. She should retain an attorney and confide only in that attorney and refer the police to her attorney. Good Luck!

The rule of thumb is to contact and speak to a criminal defense attorney first.

The police do not need to talk to your daughter to give her a break. They can do that right now by leaving her alone. The only thing that can come from a conversation with them would be a criminal charge. I would advise her NOT to talk to the police or anyone else besides an attorney that she hires.

Your daughter should not speak to the police before they charge her! You should hire an attorney to negotiate on your daughter's behalf!
