Legal Question in Criminal Law in Massachusetts

Is it legal to start a swingers group and ask for "donations" or is it prostitution? Last year I went to a swingers party that I found on Craigslists. It's a couple who organize swinger parties in hotel rooms. Couples have to pay $20 to attend, single females are free, and they allow select single men, but their "donations" are $100. Since I'm not paying a woman directly for sex is it legal? I mean on their site it said that the donation is for the snacks, drinks, condoms, costs of hotel, etc. Is there like a legal loophole that allows people to do these parties without breaking the law? The organizers are a couple and they don't participate. Is the reason they don't participate because then it would really prostitution if they did?

Depends-just because you dont "directly" pay a women dosent mean it's not prositution-remember you can pay a pimp to have sex with a women.
