is it legal for a victim who is shot in a attempted robbery in someone elses home to be charged with drugs found in the home if he does not live there

Sure. The allegations would have to be unusual, but I can imagine several plausible scenarios: for example, if the intruder and the homeowner were in business together dealing drugs, or if the intruder dropped the drugs while he was in the house.

You can be charged with anything-the question is "can the police prove the charge" If the drugs were not the person who was charged then a defense and/or motions can be made and filed.
