Legal Question in Criminal Law in Massachusetts
Lost a job
Applied for, was the best qualified for, interviewed for, but was not offered a federal technician job (I'm a Federal worker now, but it was a huge step up). It appears I was not offered the job because I had been arrested and charged with a felony two years prior. It was determined in court that I should never have been arrested and charged in the first place, and that my accuser blatantly lied, and yet, there it is on my record (the unconstitutional CORI check). I want that off my record, and even more than that, I want something on my record that shows I was arrested and charged falsely. What can I do? I lost an awesome job.

Our office can assist you in petitioning to have the record sealed or expunged based on the facts you represent.

Expungement is rarely available in Mass. As Ray said, it can be sealed. You could always get a tape and have it transcribed. Although, after two years it may no longer exist.
No, the record does not and will not show that you were arrested based on false information.
