How do I file a lawsuit against the DA for malicious prosecution?

Because the District Attorney and his or her assistants enjoy prosecutorial immunity, it is unlikely that you can successfully bring a malicious prosecution claim against the DA. The person who initiated the proceedings, e.g., the police or a private citizen, may be sued if they instituted criminal proceedings against you with malice and without probable cause, and the proceedings terminated in your favor.
