Legal Question in Criminal Law in Massachusetts
marijuana possession
i was with my boyfriend and 2 other friends off school property but still near the school. as we were walking into the woods to smoke, a campus aide rolled up in his car. he didn't know me or my boyfriend that well but the other 2 people had been caught before with marijuana and he knew they smoke. he did not ask the 3 of us our names or to empty out or pockets, just asked my boyfriend to empty out his pockets. he had all the usual things, wallet, phone, ipod, gum...... but then he also had 440 dollars. the man said ''ladies, i don't have room in the car for you so you walk back to school and hes coming with me'' (his car was empty except for himself) he took my boyfriend to school where he got searched and he had a bag with a gram, a bag with 1/2 a gram, an empty bag, a small scale, a packed pipe, and $440. Im just wondering how bad is the situation because the campus aide is NOT a police officer and he clearly dismissed the 3 of us when we were just as suspicious.... thanks for the help

Re: marijuana possession
Have criminal charges been brought against your boyfriend? If so (or if they are broughtin the future, or he gets summonsed to a 'Clerk Magistrate's Hearing'), it sounds like he has some legal defenses available to him, based on your description.
The evidence they took from him will almost certainly lead to a distriution charge, however, which is significantly more serious than simple possession. For this reason, he would be well advised to retain a lawyer and fight the distribution charge hard.

If the only charge is possession, he is lucky. He has exposure to possession with intent to sell.
You did not say if he or any of the others have been charged.
As Cragi said, he needs an attorney.
You should talk to no one, and certainly not post a detailed description on the internet.
The next person you should and must speak to is an attorney to analyze the case, and discuss your options.
