Legal Question in Criminal Law in Massachusetts
marijuana possession Class D second offense
About 6 years ago, I was arrested for a small amount of marijuana in Springfield MA. I went to court myself and was given a continuance which I completed. Now I have recently been given a summons for possession Class D on the Highway near Greenfield Massachusetts. Do you have any advice or what I am looking at for breaking the law?

Re: marijuana possession Class D second offense
It sounds like you received a continuance without a finding for your first offense.
Usually the DA is not so generous about a second offense. You could be required to plea to a guilty which can impact on your driving privileges.
You should consult an attorney to review the police report, and the facts related to the stop and the finding of marijuana. THere may be something about these facts that could benefit your and possibly suppress the evidence seized.
