Legal Question in Criminal Law in Massachusetts

Melanies Law

Im a father w/ weekend visitation 4 my 2 yr old. I left my house w/ my daughter & my GF to return my daughter 2 her mother. Car wouldnt start so a neighbor gave me jumpstart. I was almost there when my car shutoff again. Got jumpstart again so the guy who gave me jumpstart told me to follow him 2 get new battery. Car shut off again on a ramp. I went w/ the guy 2 buy a new battery my Gf & daughter stayed. I bought a battery & walked back towards the car i saw a cruiser behind & a car pulled alongside my car. I rushed over & my GF was putting cables in the trunk she told me we had 2 move 2 follow the people 2 a hotel. It took me about 30 seconds it was that close. The battery died. I waited but the cop who came 2 the hotel behind me stayed in his car. So i went 2 change the battery. The cop came & asked my GF 4 her info but not mine so i went gave him my license & he acused me of offering money. Iwent back 2 work & he came & gave me a paper saying melanies law. I didnt know whatthat was i asked my GF she had a paper 2 {Driv.w/o license}she told me what it was. We both appealed since she didnt drive but my court date is be4 hers. Pol. Report says I drove but her case is going to trial.what can i do since her case isnt solved

Re: Melanies Law

I also read and replied to your GF's question. I told her what I am telling you. From what she writes, and now even more so from what you write, it sounds like you both have good cases. You should both hire a good defense attorney. In your case, Melanie's Law is the Drinking While Driving statute. You don't mention anything about Field Sobriety tests or Breath Tests. Both of these are important to your case, whether you did or didn't take them. You can read a lot more about Melanie's Law on my web site at www.LawWorcester.com. However, you should hire an attorney who specializes in OUI/DWI cases as I do. There are a lot of things that general practitioners do not know to challenge or look at that a specialist does.
