Minor in Possession

I was at a party and the cops came so I left out the back without running into any cops and left. My backpack was confiscated from the house because it had beers in it. Now 2 months later I get a summons to court for minor in possession. Is there even a case against me if they cant prove I was there never mind in possession.

You should consider retaining an attorney to determine exactly what evidence the Commonwealth claims to have against you and speak only with that attorney and not on an open forum like this. Good Luck!

I agree with the advice given by Attorney Murray. Speaking purely hypothetically, you raise an interesting issue, but it remains to be seen what evidence the police think they have. For example, people at the party may have made statements about you to the police. In any event, you should talk to an attorney directly, rather than discussing your situation on this bulletin board.

If you have a summons there is obviously enough to bring charges. The question is will you be convicted. The answer is unlikely. They may have witnesses that place you at the party, but proving the beers were yours will be difficult. Unfortunately, you will have to hire a lawyer to represent you or get court appointed counsel if you can't afford it, but either way, get a lawyer.
