I'm not sure I understand your question. Being a family member of a convicted thief isn't a crime and carries no penalty. But the thief's immediate family will likely suffer as a result of a conviction and sentence, even if the sentence doesn't include time behind bars.

The lingering effects of a conviction will also affect the family. To illustrate, convicted criminals have a much harder time finding work, renting apartments, getting loans, etc. Criminals cannot -- and should not -- escape justice simply because being punished will also impact their loved ones.

When this happens, the perpetrators will often blame the legal system. But the fault is their own, since they brought the consequences upon themselves and their families. (This would not be true of an innocent defendant who is wrongfully convicted, but your question says that the accused really did take the money.)
