Legal Question in Criminal Law in Massachusetts

Motion to seal a record

i have filed a motion to seal a record in MA regarding a dismissal that appears on my record. NOONE in the clerks office will give me any info on procedure etc. it has been one month and they tell me it hasnt been dealt w/yet. i do not even have a date for the motion. i have written a letter to the clerk magistrate at the court. our company needs an ins policy which requires a cori check and they recommend i get it sealed so it does not get denied. we cannot accept any new clients and we are losing bus due to this. what else can i do?? the dismissal was in regards to an attack on me by a drug induced neighbor who later overdosed. when charges were filed against her along w/ a restraining order, she filed a counter complaint? against me!! what should i do

Re: Motion to seal a record

I suggest that you hire a lawyer. We seal records all the time, but it is a comlex procedure and often times people come to us after being denied by the court. If you do not follow the procedure to the letter, the application will be denied without explanation. You should hire an attorney with experince in sealing records and heed their advice. Pro se clients (those without counsel) are everyone's nightmare in the court, because while everyone has the right to represent themselves, no one really has the right to advise a pro se client. The judge cannot assist either party by virtue of his impartial role. The prosecution represents the government, who in theory is your opponent as they would prefer full disclosure. So, despite having the right to represent yourself, there is no system in place to assist you, other than private attorneys who are always available.
