Legal Question in Criminal Law in Massachusetts
My neighbor has been harrassing me for the past two years. I have kept a log with detail, times and dates. I have gone to the local police many times. 3 days ago I was working on my farm adjacent to this neighbor. There is a fence between our property. When I arrived with my tractor on my land with hay with a pitch fork to use for spreading onto the ground, the neighbor ran down the sidewalk and ran towards me yelling he was going to kill me several times. He ran into my property about 50 feet yelling the whole time about killing me. I told him to leave my property as I had work to do. He lunged toward me grabbing the pitch fork. My wife was at our house down the road and saw the whole thing and immediately called the local police. Then came and interviewed me and I told the story. They then went to him and he said I threatened him and it was in self defense. Help!

I'm not sure where this particular incident is heading in the criminal justice process, but for future purposes I suggest that you go to the police and take out a "no trespass order" against your neighbor. It's a relatively easy process. Once that is in place and he has been put on notice (which the police will do), your neighbor will be subject to arrest if he comes onto your property.
