What are the odds of me getting jail time for Identity Theft and Larceny over Under False Pretenses? I opened a credit card in someones name 2yrs ago for $500. I also have a 5wk old son so i need to be home and not in jail

Assuming you are charged and convicted, whether or not you go to jail will depend on a variety of factors, including the severity of the crime, whether or not you have a prior criminal record, the sentencing tendencies of the judge, and other things. If the amount of the theft is not great and you have no prior criminal record, the odds should be good of avoiding jail time. But there are no guarantees, and the best way to avoid jail time is to hire a good criminal attorney to represent you.
