Legal Question in Criminal Law in Massachusetts
If i have an open case for larceny over with no prior criminal history no record... first offense, what can be the chances of getting the case dismissed for community service?

It all depends on your age, circumstances of the charges, value, and what the alleged victim is seeking. Most of the 1st offense cases can be settled with an accord and satisfaction where you pay restitution to the person and in exchange your case is dismissed. There is also a good chance, if your first offense, that you could get pretrial probation, meaning the case is dismissed after a set period of time.
Retain an attorney ASAP to negotiate for such disposition as it will greatly increase your chances. Good Luck!
There is no way go predict without knowing the specific circumstances of your case. There are different ways of obtaining a dismissal, including a continued without a finding (CWOF) disposition, pretrial probation, and outright dismissal. Each of these are different, and it seems likely that one of these options might be available to you, based on what little information you've provided. If I had to guess, unless there are sugnificant mitigating factors, I would say that CWOF is a more likely plea offer than the others, but I don't know enough about your situation to say that definitively. Good luck.
