OUI probation violation MA

I am on probation for an OUI in MA. My accident occured in late March of 2008. My probation began in November of 2008 and lasts for a year. Friday night I was arrested for assisting a minor in the purchase of alcohol. The bail commisioner seemed to think the case may be dismissed. What could happen if it is not dismissed? How likely is it that it may actually get dismissed, considering I have only successfully been on probation for just under 6 months?

You need to understand that a judge will not look on it favorably that you have successfully been on probation for 6 months. He/she is far more likly to view it as you committed a crime while on probation, which is a violation of probation. I don't know how old you are, which may influence a judge somewhat, but with both of your cases involving alcohol in some way, the court is definately going to want some punishement. To avoid or minimize this you really should hire a very good criminal defense attorney. If the OUI was continued without a finding (CWOF), you do not want to lose that status and get a Guilty on your OUI for violating probation. It is likely that you will be surrendered for violation of probation. You should retain an attorney to represent you to minimize the effect of this on both the OUI and the current charge. Good Luck!
