Is it legal to take a half nude picture of your girlfriend without her permission?, we brokeup and now she says wants to take me to court to get it back.

There are two separate discussions at hand here. The first is the potential of child pornography, if your ex-girlfriend was under the age of 18 when the photograph was taken. If this is the case, you could be in a serious predicament.
The other is if she is over 18. If she is then child pornography is ruled out but she could still cause problems for you.
My suggestion is to contact an attorney if the matter proceeds any farther than it is now.

If your girlfriend is under 18, or looks under 18 in age, you may have an image of child pornography. If so, possession is a criminal act, and you can get a long prison sentence if convicted. Do not give it back, but see an attorney ASAP.
If she is over 18, why would you want it? Other than to make her angry? She may make something up about you, to get back at you. She may accuse you of rape, or something else criminal. In these disputes, being male is not to your advantage. Get out of this relationship and get rid of any nude pictures. Make sure you read paragraph 1 of this message carefully.
