Legal Question in Criminal Law in Massachusetts

possession of alcohol

My son was arrested back in march for being in a car with an open container, he was not drinking. He got community service and 100fine.

His last day of community service is wednesday 5/2/07. Then saturday 4/28/07 he was walking on campus and he was asked by campus police to hand over his backpack because they knew it had alcohol in it. They told him if he didn''t he would get in trouble so he did. They had no reason to search his bag and they kind of scared him in to it is there any hope of getting the second incident thrown out due to no probable cause to search his bag.

What is the status of the new case? Is there a scheduled clerk's hearing or arraignment? If so, hire a good attorney who knows criminal law who can file a motion to suppress and /or have the case resolved in a manner that will protect your son's record.
