Legal Question in Criminal Law in Massachusetts

Possession of Class D Drugs

I just found out that my now 23 year old daughter was arrested when she was 21 for Possession of Class D Drugs. She does not know I found out and would like to know more about what would happen to a first time offender before I confront my daughter about this. I am furious right now as I can see she's heading down the wrong path. I am affraid that this will effect her getting a job as she just graduated college and I know that job applications ask if you have ever been convicted. Can someone help me?

Re: Possession of Class D Drugs

probably a cwof as atty murray says. young people make mistakes. that's why they usu get a cwof disposition if no pattern of prior criminal offenses. class d is not serious. give her a break? the court probably already did. (she is also an adult now.)

Re: Possession of Class D Drugs

Typically a first offender charged with possession of Class D would be granted a continuance without a finding if there were sufficient facts found to make a finding. This could be dismissed, usually within a year, if no further difficulties occurred within that time. Hopefully this is the case with your daughter and gives you some peace of mind.

Re: Possession of Class D Drugs

I suggest that you contact the clerk in the district court where the case was brought and find out what the disposition was for her case. There are a range of possibilities, and we would only be guessing without knowing that information.
