Legal Question in Criminal Law in Massachusetts
Probable cause tape recordings
probable cause hearings held at district court December of 1986. Is it true that tape recordings of the probable cause hearings, at that time, only required the tapes to be held for one year, then erased. Although the trial date was scheduled for 2-11-88 tapes were destroyed in 12-1987, and not reduced to transcript form. Thank You

Re: Probable cause tape recordings
For many years when hearings and sessions were recorded, the tapes usually existed for a limited time. It is and was up to the parties to ask to preserve the tapes, or, better, to get a copy of the tape. Finding a tape for that year would require more than a miracle.
