Legal Question in Criminal Law in Massachusetts

Probation violation
A friend was arrested on a probation violation. Was taken to court for a hearing and given a trial date. The date has passed without him going to court. He has not heard from his court appointed attorney, all attempts to contact him have failed. He has not had any contact with anyone regarding this matter. What are his legal rights regarding this matter. He would like to know whats going on with his case but no one at the jail can give him any information. And the Social workers there will not help him out.

Your friend should call or write to his attorney. It is your friend's responsibility to let his attorney know where he is. The appointed attorney may not know where your friend is. If the date has come and gone, your friend probably has a default on his record, and will not be released until the matter is taken care of. If he is unable to contact his attorney, he should also write to the Court, and ask that they issue a "Haeb" to bring him to Court -- and he should copy his attorney on that request.
