being questionned by the police

my nephew was just taken into custody from home. they would not let him put on pants or sock, the police officers told his parents to call in an hour and see if they were ready for them. Is this legal?? He is 17

I hope that they mirandized him and told him about his right to an attorney. This is quite odd.

In most cases, it is okay for police to do this. He is 17, so he is no longer a juvenile. Since he was just taken into custody, it is important that you take these steps to make sure that your nephew's rights are protected:

Call the police and get the basics. Ask where he is being held and what the charges are.

If you speak with your nephew, do not discuss the facts of the case. Your conversation may be recorded and may be used against him.

Tell your nephew to remain silent and not to take any tests.

Write everything down. Document who you spoke to, what you talked about and when.

Call a lawyer. Find someone who is experienced in criminal law.

If you can't find a lawyer right away, then try to get the person released on bail.

Keep looking for a qualified criminal defense lawyer.
