rape of a minor

Both parties are 17 yrs of age. Both in D.S.S. what are the chances of the victim, to get resolution of the offender to be inprisoned? the victim was under prescription sleep medication at the time of the incident and was forced into consent but would have not given consent if in awake state. Victim has been assulted both physical and sexually by the offender. victim was forced into the act due to being ''beaten'' earlier that day and was scared of what may happen if she continued to say that she ''did not want to''. Please write back due to this is still new and happened just a few days ago. we are seeking professional assistance but would like to know all our laws and options for her to continue to be strong and know what she is up against. thank you very worried and concerned.

First and most importantly, you need to report this to the police immediately and take the victim to a hospital for an examination. Second, get a copy of the prescription or name of the medication and give this to the police as well. Third, be prepared to talk about what happened; this is often the most traumatic part, sometimes worse than the actual crime. Be strong and do not be afraid.

Most police departments have an office or detective assigned especially to such situations. The longer you wait, the harder it may be for them to prosecute the case. The police investigation will be detailed, and they will probably take the victim for a medical evaluation usually by a qualified nurse who will be part of the evaluation and investigation. The police will advise you about your options. However, you may also wish to consult with an attorney to discuss this situation, and to assist you through the process.
