This sounds like a matter wherein you need to consult and attorney. The combination of your fears, and your husband's history and conduct make for a bad brew.

As Ray said, such recordings are illegal, and subject to civil and criminal actions.

If you are separating and planning to divorce, you should meet with an attorney to discuss your options before you separate.

Should you have any questions, contact me.
