Recording a conversation

I recently had a conversation with a person whom I informed that I wanted to record our conversation. I had the recorder in my hand an the person said that they do not participate in recorded conversations i placed the recorder down on his desk and he began to speak. I never turned the recorder off. Can i use this recording in a legal proceeding in Massachusetts
