Restraining Order Neighbot

I had to call police on my neighbor tonight; I woke up to him in my bed groping me; screamed for him to get out a couple of times; called police and they arrested him; he has been harrassing me for years but I thought he was harmless until now. The police told me I should file a restraining order. Can I do that with it being my neighbor?

The first answer is accurate, you are not entitle to a 209a, or domestic violence, restraining order. You can get one is Superior court however its violation is not a crime other than perhaps criminal contempt. Your neighbor has committed some very serious offenses here. I hope he has been arrested and therefore is going to be arraigned. You should contact the district attorney's office in the court that your neighbor will be brought to. Make sure that they request a stay away/ no contact order as part of his terms of release.
