Legal Question in Criminal Law in Massachusetts
retainer
A lawyer took a $ 2000.00 retainer from me then said we were a bad match and he was no longer my lawyer and would give the retainer back. He has not returned any of the money. What can I do?

I agree with Attorney Bace. I suggest that you send the letter by certified mail, return receipt requested, and that your letter give the lawyer a deadline (for example, 10 days after his receipt of your letter) to return your money before you take further action. Hopefully, the attorney will respond to your letter in an appropriate way. If not, the next option I would suggest would probably be to file a complaint in small claims court, seeking return of your money.
Re: retainer
At the very least, you should request in writing that the retainer be returned to you.
The retainer funds are your property if no work has been done, and ethically should be returned as soon as either of you terminate the relationship.
