Legal Question in Criminal Law in Massachusetts

Search and Seizure Question?

A police officer sees Lisa walking down the street. He decides to stop her and search her for no other reason than to see what she is doing. During the search, the officer discovers a hand gun in Lisa'a purse. The officer arrests Lisa for carrying a concealed weapon without a permit, a felony in that state. The officer informs Lisa of her Miranda rights. The officer then has the lab run routine tests on the gun and discovers that it was used in a triple murder of a mother, father, and their 2 month old son. The officer confronts Lisa with this evidence and she confesses to the crime. At Trial the State will be able to introduce the gun, the lab tests and the confession into evidence.

True or False???

Please help.

I dont believe that the officer had probable cause to search her.

: Search and Seizure Question?

The issue that you are raising deals with suppression of part or all of the evidence.

I hope that she is represented, and that the her attorney considered filing motions to suppress?
