Legal Question in Criminal Law in Massachusetts

Sexual assault accusation

A friend of mine who lives in Georgia was notified that a girl in Boston, MA has been going to therapy and told her therapist that 5 years ago when she was 15-16 years old, he molested her while he was visiting. Her therapist notified the Boston police. He has yet to be contacted by the authorities of either state. Will an investigation automatically be pursued and will he be contacted by authorities? Or does the girl or her family need to press charges first?

Re: Sexual assault accusation

The specific officer which the therapist spoke to will know the status of the investigation in Boston. Presumably, the girl herself who is now 20-21 years old will have to corroborate this with the Boston Police for any charges to be filed. The charges would have to be filed in Massachusetts since the alleged crime happened here. Your friend must wait and see if charges will be filed. I would advise him to not speak with the police without having an attorney present or to consult with an attorney before hand.

I agree and I would add that your friend should contact a criminal defense attorney NOW. Your friend needs to discuss this, and make plans should he be contacted, or should legal action be filed.

If you need such assistance, contact me.
