If the State has evidence, Yes.

I am not sure that the previous answer provides you with the information you need. In a criminal case, the district attorney has several different ways to introduce evidence of a crime. Some of these should have been explained to you by your attorney.
The death of an alleged victim may be some evidence that could provide a defendant with an additional assist.
