Legal Question in Criminal Law in Massachusetts
Shoplifting fines
Hello, my daughter got caught stealing at the mall this past weekend. She was in two seperate stores and when the one caught her she fessed up to both. The total dollar amount was $8.00 from one store and $20.00 from the other. There were no formal charges filed although they said they were going to mail her info and the incident report to the home office who would then send us a letter and possible fine. Should I pay them directly? Is this even legal? What other pitfalls should I be watching out for? Thanks,

Re: Shoplifting fines
Often what happens is that you get a threatening letter from some lawyers representing the stores wanting money. If you are concerned, and assuming that no charges are filed, you can go to the stores, and tell them without admitting anything that apparently your daughter is suspected, and you just want to pay them the money they suggest was lost.
Admit nothing, and sign nothing. Get a receipt.
